Terms of Use

These Terms of Use (the "Terms") govern access to and use of the website jemio.ru by any person ("User").

These Terms do not replace the Public Offer Agreement for Jemio Studio services and apply together with it, the Personal Data Processing Policy, the Consent to Personal Data Processing, and the Cookie Policy.

By using jemio.ru, the User agrees to these Terms. If the User does not agree with any provision, they must cease using the website.

1. Website Owner

2. Age Restriction

The website is intended for individuals aged 18 or older, acting in a professional (B2B) capacity. Persons under 18 are not permitted to use the site.

3. Intellectual Property

All materials on the site (texts, photographs, design, graphics, logos, software code, interface elements) are owned by IE Khamzin A.M. or used under lawful basis, and are protected by:

  • Chapters 70, 71, 76 of the Russian Civil Code;
  • Directive (EU) 2019/790 on copyright in the Digital Single Market (for EU users);
  • Turkish Law No. 5846 on Intellectual and Artistic Works (for Turkish users);
  • international treaties (Berne Convention, TRIPS Agreement).

3.1. Permitted Use

The User may:

  • browse and use the site for their own informational and business purposes;
  • quote materials with mandatory attribution — jemio.ru;
  • request services through the enquiry form.

3.2. Prohibited Use

Without prior written permission of the Owner, the following are prohibited:

  • copying, reproduction, distribution of site materials for commercial purposes;
  • modification or creation of derivative works;
  • scraping, automated data collection, circumvention of technical protections;
  • reverse engineering of source code;
  • posting site materials on other resources to substitute or compete with jemio.ru;
  • using the site to distribute spam, malware, phishing, or other unlawful activity;
  • any use that may threaten the site's operability or violate the rights of other users.

4. User-Generated Content

When submitting the form, the User provides the Owner with:

  • Personal information (processed under the Personal Data Processing Policy);
  • Source materials (photographs, brief, references) for which the User warrants having lawful rights to use and transfer to third parties for order fulfilment.

The User warrants that submitted materials do not infringe the copyright, related, or other exclusive rights of third parties, and holds the Owner harmless from any claims related to submitted materials.

The Owner may refuse an enquiry if there are reasonable grounds to believe that materials were obtained in violation of third-party rights.

5. Demonstration Works

Works displayed in the "Works" (portfolio) section are demonstration works. They do not represent completed commercial projects with real clients (as of the publication date of these Terms) and were created by Jemio Studio solely to showcase possible styles, formats, poses, and angles of future photoshoots.

Demonstration works may not be used by third parties for commercial purposes without written permission of the Owner.

5.1. Works produced for clients

As commercial orders are delivered, the "Works" section may also display results created for real clients. Such materials are published under clause 12.5 of the Public Offer Agreement: the Owner may use a result in its portfolio unless the Client has stated a written prohibition in the task, a separate letter, or a non-disclosure agreement. Such a prohibition applies indefinitely; if received after publication, the relevant materials are removed within 10 (ten) business days.

6. No Warranties ("As Is")

The site and its materials are provided "as is". The Owner does not warrant:

  • suitability of demonstration works for the User's specific purposes;
  • uninterrupted operation of the site at any given moment;
  • absence of errors in texts, images, or code;
  • compatibility with all browsers, devices, and operating systems.

The Owner is not liable for direct or indirect damages arising from use or inability to use the site.

7. Third-Party Links

The site may contain links to third-party resources (Telegram, Yandex, payment systems, legal references). The Owner is not responsible for the content of such resources, their availability, privacy policies, or consequences of their use.

8. User Responsibility

The User bears full responsibility for:

  • accuracy of information submitted through the enquiry form;
  • lawfulness of materials uploaded to the site;
  • security of any account credentials used;
  • compliance with these Terms and applicable law.

In case of breach, the Owner may:

  • restrict or terminate the User's access to the site;
  • notify competent authorities;
  • claim damages under applicable law.

9. Governing Law and Jurisdiction

9.1. Governing Law

These Terms are governed by the law of the Russian Federation.

For Users located in the EU and Turkey, mandatory local consumer protection and data protection provisions (GDPR, KVKK) may additionally apply.

9.2. Dispute Resolution

All disputes are resolved through negotiation. Mandatory pre-court procedure — a written claim sent to hello@jemio.ru; the period for responding to a claim is 14 (fourteen) calendar days from its receipt (aligned with clause 18.2 of the Public Offer Agreement).

Failing settlement, disputes are subject to the courts at the Owner's location (Russian Federation), unless otherwise required by mandatory provisions of applicable law.

10. Changes to Terms

The Owner may amend these Terms. The new version enters into force upon publication at jemio.ru/legal/terms.

Continued use of the site after publication of a new version constitutes acceptance of the changes. If the User does not agree, they must cease using the site.
